Classiq Art is operated by Inferens, registered in the Netherlands under Chamber of Commerce number 60406151, with its registered office in Soest, the Netherlands. We are the data controller responsible for your personal data.

2. What Data We Collect

We collect only the data necessary to provide and improve our service:

  • Account data: email address and password (hashed) when you create an account.
  • Profile data: display name and avatar URL, if you choose to provide them.
  • Order data: billing and shipping details, order history, and payment confirmation references.
  • Uploaded images: photographs you submit for artwork generation.
  • Usage data: anonymised analytics on page visits and feature usage to help us improve the product.

3. How We Use AI

Your uploaded photographs are processed by third-party artificial intelligence (AI) services to generate stylised artwork. These services receive your image solely for the purpose of generating your order and do not retain it for training or other purposes beyond what is necessary to fulfil the request.

By using Classiq Art, you acknowledge and consent to this AI processing as an essential part of the service.

4. Legal Basis for Processing

Under the General Data Protection Regulation (GDPR), we process your personal data on the following legal bases:

  • Contractual necessity — to create your account and fulfil your orders.
  • Consent — where you explicitly agree (e.g. to our terms or optional features).
  • Legitimate interests — for fraud prevention, service improvement, and legal compliance.
  • Legal obligation — where required by tax, accounting, or consumer protection laws.

5. Data Sharing & Third Parties

We do not sell your personal data. We share data only with trusted service providers necessary to operate the business:

  • Payment processor (Stripe) — to handle transactions securely.
  • Cloud infrastructure — to host and store data securely.
  • AI generation services — to process your images into artwork.
  • Shipping & print partners — to produce and deliver physical orders.

All third-party providers are bound by data-processing agreements and process your data only on our instructions.

6. Cookies & Tracking

We use essential cookies to keep you signed in and maintain your session. We also use basic analytics cookies to understand how visitors use our site. You can disable non-essential cookies through your browser settings.

7. Data Retention

We keep your data only as long as necessary:

  • Account data: retained while your account is active; deleted within 30 days of account deletion.
  • Order data: retained for 7 years to comply with Dutch tax and accounting obligations.
  • Uploaded images: retained for order fulfilment and quality assurance; deleted upon request or account closure.
  • Analytics data: anonymised and retained indefinitely for product improvement.

8. Your Rights

Under GDPR, you have the right to:

  • Access the personal data we hold about you.
  • Rectify inaccurate or incomplete data.
  • Erasure ("right to be forgotten") in certain circumstances.
  • Restrict or object to processing.
  • Data portability — receive your data in a structured, machine-readable format.
  • Withdraw consent at any time (without affecting the lawfulness of processing before withdrawal).

9. Data Security

We implement industry-standard technical and organisational measures to protect your data, including encryption in transit (TLS), secure authentication, and access controls. However, no system is completely secure, and we cannot guarantee absolute security.

Some of our service providers may process data outside the European Economic Area (EEA). Where this occurs, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses (SCCs) approved by the European Commission.
